Ardex Australia offers innovative products of outstanding quality and optimal environmental friendliness, as well as providing training and support services for their application.

 

2. Open and transparent management of personal information

This Privacy Policy (Policy) sets out Ardex Australia’s policy on the management of information collected about you, including personal information. Ardex Australia is fully committed to ensuring the proper management and use of all personal information it collects and handles in accordance with applicable Australian privacy laws, including the Australian Privacy Principles.

This Policy covers any information (including personal information) collected in Australia from customers, retailers and visitors to any website operated by Ardex Australia. The Policy does not apply to information (including personal information) collected by third parties, such as payment gateway providers, or through third party websites linked to this website. Ardex Australia may review and update this Policy from time to time by posting the updated Policy on its websites.   • – for suppliers, contractors and retailers: Ardex Australia uses information collected to explore business opportunities for the provision of Ardex Australia products (or parts of them) and services along the supply chain and through distribution channels, and to exercise rights under the applicable contracts with suppliers, contractors and retailers.

Ardex Australia may disclose personal information to third party suppliers and contractors to the extent it is necessary for them to provide products and services to Ardex Australia, or if required by law, a court or an enforcement agency that has power to require disclosure of such personal information.

For some Ardex Australia websites, you may have the opportunity to pay for products or services you purchase using PayPal. Ardex Australia only retains personal information for as long as required by law and needed for our business functions and activities. It is then securely destroyed and disposed of.

 

10. Quality

Ardex Australia will ensure, to the extent reasonably practicable, that personal information collected, used or disclosed is accurate, up-to-date, complete and relevant. If Ardex Australia becomes aware that any of the personal information it holds is inaccurate it will take prompt steps to update its records so that the personal information collected, used or disclosed is accurate, up-to-date, complete and relevant.

 

11. Access and correction

Subject to verification of your identity, if Ardex Australia holds personal information about you then you may make a request to access, update or correct this personal information at any time.

Ardex Australia will give you access to your personal information that it holds subject to a few exceptions. Ardex Australia will not give you access to your personal information that it holds if:

  • – Ardex Australia reasonably believes giving you access would pose a threat to the life, health and safety of any individual;
  • – giving access is likely to unreasonably impact the privacy of others;
  • – your request is frivolous or vexatious;
  • – the information relates to existing or anticipated legal proceedings between you and Ardex Australia and that information would not be discoverable in legal proceedings;
  • – giving access would prejudice any negotiations between Ardex Australia and you;
  • – giving access would be unlawful;
  • – giving access would likely prejudice taking appropriate action where there is reason to suspect unlawful activity or misconduct of a serious nature; or
  • – giving access may prejudice enforcement activities, or a commercially sensitive decision-making process.

Ardex Australia will provide written reasons for any refusal to give access.

If there is a substantial amount of personal information that needs to be accessed, Ardex Australia may charge you a fee to recover its reasonable costs in supplying you with the information you requested. Ardex Australia will notify you of the amount of the fee when it responds to the request but before it gives access to the information. There is no fee to make a request for access to your personal information.

If you hold an online account with Ardex Australia (e.g. through the RDX Store), you may access and correct your personal details at any time by logging into your online account. Alternatively, access and correction requests should be made in writing to Ardex Australia’s privacy officer using the details set out in section 12 (Contact us about privacy questions) of this Policy.

Ardex Australia will aim to respond to written requests for access and correction of personal information within 15 business days after a request is received by Ardex Australia. Where Ardex Australia is unable give access or correct the information (as applicable) within 15 business days, it will notify you of the reason for the delay and provide an indication of when it expects to give access or correct the information (as applicable).

Ardex Australia will:

  • – aim to resolve a complaint within 45 business days.

It may not always be possible to resolve a complaint within 45 business days. If Ardex Australia is unable to resolve a complaint within 45 business days, it will notify you of the reason for the delay and provide an indication of when Ardex Australia expects to resolve the complaint.
